1. Introduction and Agreement
These Terms of Service ("Terms") are a binding agreement between you and Lead Skills, LLC ("Company", "we", "us", or "our"), operator of Hard Money Lenders of New York (the "Site"). By accessing the Site, submitting an inquiry, or otherwise using any feature of the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Site.
2. Our Role: Lead Generation Service
The Site is an advertising and lead-generation service. Our role is to connect consumers interested in hard money financing with one or more participating hard money lenders who may be able to provide financing. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions — including loan approval, loan amount, interest rate, fees, other terms, and funding timelines — are made solely by the participating lender. Each participating lender is an independent company responsible for its own products, services, compliance, and communications.
3. No Offer or Solicitation
Nothing on the Site is an offer, commitment, or solicitation by the Company to make a loan, extend credit, or provide any financial service. Information on the Site is for general informational purposes only and may not be accurate, complete, or current. Submitting an inquiry does not guarantee that you will be matched with a participating lender or receive a loan offer. All loan programs referenced on the Site are offered by participating lenders and are subject to borrower and property qualification, lender underwriting, and final approval by the lender.
4. Eligibility
To use the Site, you must be at least 18 years old, legally capable of entering into a binding contract, and not barred from using the Site under applicable law. You agree to provide accurate, current, and complete information in connection with any inquiry you submit, and to promptly update such information as necessary.
5. Your Consent to Be Contacted
By submitting an inquiry and checking the consent box on our contact form, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand that your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies. You can opt out at any time by replying STOP to any text or calling 646-466-6504. A current list of participating lenders is available upon request.
6. Equal Opportunity
Hard Money Lenders of New York connects borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age. The Site does not select matches or make referrals on the basis of any protected characteristic.
7. Acceptable Use
You agree not to:
- Use the Site for any unlawful, fraudulent, or unauthorized purpose or in violation of these Terms.
- Submit false, misleading, or inaccurate information, including using another person's identity or contact information without authorization.
- Interfere with or disrupt the Site, attempt unauthorized access, probe or test the vulnerability of any system, or circumvent any security or authentication measure.
- Use automated tools to access, scrape, or copy content from the Site without our prior written consent.
- Upload, transmit, or distribute any malicious code, harmful material, or content that infringes the rights of others.
8. Intellectual Property
All text, design, logos, graphics, images, software, and other content on the Site are owned by or licensed to the Company and are protected by applicable intellectual property laws. Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for its intended purpose. You may not copy, reproduce, modify, distribute, publish, or create derivative works based on any portion of the Site without our prior written consent.
9. Third-Party Links and Services
The Site may contain links to third-party websites, including the websites of participating lenders and other service providers. Third-party sites and services are independent of the Company, and we do not control or endorse them. Your interactions with any third party, including participating lenders, are solely between you and that third party and are governed by that third party's terms and policies. We are not responsible for the content, practices, products, or services of any third party.
10. Disclaimers
THE SITE AND ALL CONTENT, INFORMATION, AND SERVICES AVAILABLE ON OR THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING ANY PARTICIPATING LENDER OR ANY LOAN PRODUCT, DECISION, OR OUTCOME.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, ANY CONDUCT OR CONTENT OF ANY THIRD PARTY (INCLUDING ANY PARTICIPATING LENDER), OR ANY DECISION MADE OR ACTION TAKEN IN RELIANCE ON THE SITE. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
12. Indemnification
You agree to defend, indemnify, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use or misuse of the Site, (b) your violation of these Terms, (c) your violation of any applicable law or the rights of any third party, or (d) any information you submit through the Site.
13. Governing Law
These Terms and any dispute arising out of or relating to the Site are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Exclusive jurisdiction and venue for any action arising out of or relating to these Terms will lie in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.
14. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the Terms were last revised. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.
